Welcome to Safir! These Terms and Conditions ("Terms") govern your use of the Safir mobile application ("App") and the services provided through it. By accessing or using our App, you agree to comply with these Terms. Please review them carefully.

  1. Definitions:

    • "Safir" refers to our mobile application and the services offered through it.
    • "User" refers to any person who uses our App.
    • "Partner" refers to individuals providing transportation services through our App.

  2. Use of Safir:

    • Eligibility: By using our App, you affirm that you are at least 18 years old and legally capable of entering into a binding agreement.
    • License: We grant you a limited, non-exclusive, revocable license to use our App for its intended purposes.
    • Prohibited Activities: You agree not to:
      • Use our App for any unlawful or unauthorized purpose.
      • Attempt to circumvent any security measures or access any part of the App that you are not authorized to access.
      • Disrupt the operation of our App or interfere with our services.

  3. Transportation Services:

    • Booking: The App allows you to book transportation services provided by partners.
    • Payments: You agree to pay for transportation services booked through our App in line with the applicable pricing and payment terms.
    • Cancellation: You may cancel a booking in accordance with our cancellation policy, which may vary depending on the circumstances.

  4. User Conduct:

    • Compliance: You agree to comply with all applicable laws and regulations while using our App.
    • Prohibited Conduct: You agree not to:
      • Use our App in any manner that could interfere with, disrupt, or negatively impact other users’ experience.
      • Upload or transmit any content that is illegal, defamatory, obscene, offensive, or otherwise objectionable.

  5. Intellectual Property:

    • Ownership: Safir and its licensors retain all rights, titles, and interests in and to our App and its content, including all intellectual property rights.
    • License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use our App for your personal, non-commercial use.

  6. Privacy:

    • Collection of Information: We may collect and use your information in accordance with our Privacy Policy.
    • Cookies: By using our App, you consent to the use of cookies as described in our Privacy Policy.

  7. Disclaimer of Warranties:

    • As-Is Basis: Our App is provided on an "as-is" and "as available" basis, without any warranties of any kind, whether express or implied.
    • Use at Your Own Risk: Your use of our App is at your own risk. We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  8. Limitation of Liability:

    • Exclusion of Liability: In no event shall Safir, its directors, officers, employees, or agents be liable for any indirect, consequential, incidental, special, or punitive damages arising out of or in connection with your use of our App.
    • Total Liability: Our total liability to you for all claims arising from these Terms or your use of our App will not exceed the total amount paid by you, if any, to us in the six months preceding the event giving rise to the liability.

  9. Indemnification:

    • Defense and Indemnity: You agree to indemnify, defend, and hold harmless Safir, along with its directors, officers, employees, and agents, from any and all claims, damages, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of or access to our App; (b) your breach of any of these Terms; or (c) your infringement of any third-party rights, including without limitation any copyright, property, or privacy rights.

  10. Termination:

  • Termination: We may terminate or suspend your access to our App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
  • Survival: Upon termination, your right to use our App will cease immediately, and all provisions of these Terms that should survive termination will do so, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

  • These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law principles.

  • Amendments: We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

Account Deletion Policy:

We respect your right to control your personal information. If you wish to delete your Safir account, you can do so at any time through the app.

  • How to Delete Your Account: Navigate to the Menu in the Safir app, select Account Settings, and choose the option to Delete Account. Follow the prompts to complete the process.
  • Effect of Deletion: Once your account is deleted, your personal data will be permanently removed from our systems, except where retention is required for legal or regulatory purposes.

By using the Safir App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
